【大紀元2013年09月09日訊】控告事項：1、請求確認依蘭法院剝奪辯護權的庭審無效，並處理相關責任人員。

2、依法重新開庭，維護國家審判權的正確行使，並依據政教分離的文明原則，從信仰無罪的憲政高度，裁定關於法輪功信仰的案件不屬於司法機關管轄範圍。

毛宏偉 廣東人民時代律師事務所律師，系張惠娟的辯護律師

尚寶軍 北京莫少平律師事務所律師，系左振歧的辯護律師
郭海躍 北京道衡律師事務所律師系，系劉鳳成的辯護律師

被控告人：
張安克、呂守芳等合議庭人員
寧巖等依蘭縣檢察院公訴人員

事實與理由：

依蘭縣法院6月17日開庭審理莫志奎、張金庫、孫文富、徐峰、李大朋，莫志奎家屬依法委託了北京姜一兵律師和黎雄兵律師，但依蘭縣法院非法阻止黎雄兵律師進入法庭參加庭審，為當事人辯護。庭審中，法院也打斷辯護人的發言。

依蘭縣法院7月31日下午開庭審理張惠娟、段淑妍、孟凡影，張惠娟委託的廣東律師毛宏偉，孟凡影委託的北京律師董前勇及其女兒邢翠翠，都被依蘭法院違法拒絕送達起訴書及安排閱卷，其中，依蘭法院主審法官張安克違法要求孟凡影女兒提供其母親簽名的委託書後又荒唐的先以忘了通知後又以司法局不同意為由不讓其為母親辯護。

庭審中，張惠娟、段淑妍、孟凡影庭審全部過程中，因沒有律師為他們辯護，三個當事人沒有說一句話，證據沒有得到當事人的任何質證。

2013年7月31日下午，依蘭法院開庭審理左振歧、劉鳳成，左振歧的律師北京莫少平律師事務所尚寶軍因法院主審法官張安克違法要求律師前往依蘭司法局查驗律師證及審查律師是否是修煉法輪功而拒收律師手續，不送達起訴書及安排閱卷，哈爾濱看守所因裝修無法在法律規定的48小時內安排會見，律師午飯履行職責而退出辯護。

庭審中，劉鳳成的律師北京律師郭海躍，被法官張安克多次打斷，始終在律師說一句就強烈打斷，禁止律師談案件性質和憲法條文，辯護律師的麥克風被法院故意消聲，無法有效履行辯護職責。

中國法律明確規定公民有自我辯護和委託律師和家屬為自己辯護的權利。

依蘭法院以上系破壞法律實施的違法行為，不尊重國家審判權的違反憲法的行為，必須依法糾正，維護國家法律的尊嚴。

【劉人瑋／台東報導】台東縣警局昨接獲協尋案件，一位53歲李姓民眾向妻子稱想看嘉明湖一帶風景，帶著簡便行李隨即出發，事後妻子無法取得聯繫因此報案。

警方尋找下，今天早上６時許在海端鄉力稻的崖下尋獲，李姓民眾身體卡在路面下200公尺的山壁，明顯死亡多時，30多名警義消花了近3小時才將死者吊起，警方目前正進一步了解死者墜谷原因。
