檢察總長黃世銘出手拉下法務部長曾勇夫，整個過程遭檢察圈內強烈質疑是假「刑事犯罪調查」之名，行「行政調查」之實；而為達目的、不擇手段的結果，更給自己惹來違法監聽、向總統洩密、羅織曾勇夫罪名的指控。一波檢察內部的風暴正起，未來台北地檢署更可能偵辦特偵組的違法失職。黃世銘此番出手弄得兩敗俱傷，連法務部長曾勇夫都感嘆對不憑證據指控的不齒，一般老百姓又如何能期待司法的保障。

黃世銘辦關說案，首先要釐清本案是行政調查，還是刑事犯罪調查，黃世銘自認為超完美切割的辦案，但卻漏洞百出。熟稔刑事偵辦的不少資深檢察官普遍認為，因監聽而意外發現柯建銘請王金平，向曾勇夫關說，然後再透過高檢署檢察長陳守煌，關說承辦檢察官林秀濤不上訴。但林秀濤認為作證的證詞，遭特偵組刻意扭曲，前提基礎已經有瑕疵，導出的結果如何讓人信服？

檢察圈內質疑，以刑事犯罪手段，查辦行政事項，最後，再由偵辦首長犯罪的特偵組，對外召開記者會說明行政調查的結果，特偵組此舉角色多樣，也難怪會遭批評是內鬥自家人。

黃世銘身為檢察總長，理應深知程序正義的重要性，但他屢屢將程序的必要擺在一旁，未來國會開議後，乃至台北地檢署介入偵辦特偵組的違法失職，勢必要釐清監聽的基礎，是否為浮濫監聽的結果，是否為巧立案件以行行政調查之實。由於此關說案的偵辦，手段極為粗糙，也隱含黃總長向馬總統洩密之內情。

以目前情勢看，黃世銘雖「幹掉」曾勇夫，卻也未必得利，還可能落得兩敗俱傷。如果黃世銘之後因此接掌法務部長，如何領導檢察機關？檢察官未來辦案時，是否也要不達目的，不擇手段去知法玩法，受傷的將是全民老百姓和司法的威信。
