公平會昨（1）日宣布，台塑、台化兩公司濫用市場獨占地位，拒賣化工原料給合一實業公司，各罰200萬元和300萬元。值得玩味的是，合一負責人正是外傳與王文洋友好的王永慶外甥周俊雄，自家人槓上自家人事件再添一樁。

公平會副主委孫立群指出，台化生產的芒硝和台塑生產的燒鹼在台市占率都超過五成，卻分別從去年7月和10月起，無合理理由斷絕對中盤商合一實業供貨，造成合一實業需以更高價格向同業或國外購買相同產品，妨礙其參與市場競爭，分別罰台塑200萬元、台化300萬元。

孫立群指出，台化辯稱為了因應嫘縈棉減產，才減少芒硝生產，未刻意停止供貨。但公平會調查發現，台化在去年8月後，該產品產量持續成長，且未停止與其他業者進行該項產品交易，其宣稱與事實不符。

另一方面，台塑辯稱合一經常沒有足量領取約定的產品數量，影響公司正常運作，才停止供貨。但公平會調查發現，合一過去不足額和超額提領產品互見，加上同期其他業者也有類似情況，台塑卻只針對合一斷貨，也不採信台塑理由。

孫立群說，獨占業者若有正當商業理由，有停止對其他業者供貨的自由，因此台塑、台化所提理由是否合理，是判斷違法與否的關鍵。

他坦言，今年3月一度要對外發布此案裁決，但當時委員還有疑慮，臨時暫緩公布，直到日前才確定開罰。

孫立群表示，雖然此次罰鍰金額不大，但已超過合一的經濟損失，且公平會已令台塑、台化停止違法行為，若不改善，可連續裁罰。孫立群還警告，若相關違犯惡性重大，最高可罰業者前一年營業額的一成罰鍰。

值得注意的是，合一負責人是台塑集團已故創辦人王永慶外甥周俊雄。他曾在王家二、三房爭產風波中居間協調，外傳與王永慶二房長子王文洋友好，此案到頭來原是自家人槓自家人。

孫立群對此表示，公平會只就違法行為處分，此案背後若有其他糾葛，並非關注範圍，不便多做評論。
