車禍鑑定相關

我在去年11月車禍

原因是我騎乘機車時速40
他是我後車
我有注意 我的旁邊那時確實沒有車子直線行駛
結果他從我的機車排氣管那邊撞下去導致我跌倒

後來因調解不成 提出過失傷害

對方是嘉義地院的退休書記官
態度很高傲

後來開庭後 由法院提出調解一次
我們申請鑑定 鑑定說我完全責任
後來翻了監視器 是它在撞我的那一刻 剛好被樹葉擋到
他撞我我加速度往前 看起來很像我超他車
那這樣我該怎麼維護我自己的權益?
