夫妻因贈與轉讓股票 免繳證交稅

財政部表示，夫妻間股票轉讓，可以免繳納證券交易稅。

凡買賣經銀行簽證的股票，依證券交易稅條例第1條第1項規定，應繳納證券交易稅；但股票若因贈與取得者，非屬買賣行為，應免課證券交易稅。

財政部指出，夫妻間因贈與轉讓取得股票，依遺產及贈與稅法第20條第6款規定，配偶相互贈與財產，不計入贈與總額，贈與人可向所轄國稅局申報贈與該項股票，由國稅局核發不計入贈與總額證明書，憑此證明書即可向股票發行公司辦理贈與股票過戶登記，免繳納證券交易稅。
