補習班合約問題(希望懂法律、或有處理過想關問題的人幫忙解惑)

1.我想請問如9月1號簽合約(雙方談好薪資、合約起迄日期並簽名)，但合約上約聘起始日期為9月5號開始，那麼這份合約生效了嗎?

2.另外我想請問現在的補習班一定要簽約、試用期不給薪水、離職須提前幾個月告知否則違約，這樣究竟合不合理?

3.離職被指責無人帶班造成補習班損失，直接從薪水扣薪水，是否違反勞基法第22及26條?

4.補習班常以一句責任制，好像加班都理所當然，這樣沒有法律約束嗎?
