想請教關於亞太電信續約.違約問題.

 今年5月中我接獲亞太直營店門市的通知.說我合約即將到期.詢問我是否要續約.老實說我並不清楚我的合約到底什麼時候到期.因這門號我已經用了7-8年了.當時也沒打算要換.所以也沒問清楚就同意了.
收到新手機之後.只用了3天他卻壞掉了(5月中寄來.我到了9/8號才用.所以已經過瑕疵品換新機的期限).

接著我去電詢問服務人員順便提及了我的合約書內容.感覺有點疑惑.
服務人員跟我說她們可以提前1年與客戶續約.但是我的舊有合約可是得到明年的2015/10/30才到期.在怎麼樣也不該是在今年5月跟我說我合約到期了吧!!

所以請教

1.我有去電客服.客服說我續了2年的約.但是我的合約書上顯示的是一年(由2015/11-2016/11).所以我的合約應當遵照合約日期嗎?
2.另如我想違約.我需付多少違約金?如果業務人員事先違法在先.這份合約是否生效?(我剛才看了一些知識上的一些相關問題.說要舊約到期前6個月才能詢問是否續約?)
3.門市人員這種做法算欺騙嗎?
