洪仲丘案 15日移桃園地院審理

司法院晚間表示，總統今天公布軍審法修正案，依據法律規定，公布後第三天即生效。因此，陸軍下士洪仲丘命案，會在本週四移送桃園地方法院審理。

軍審法部分條文修正案，經總統公布後，會採【一次到位，二階段生效】方式，讓【違反陸海空刑法中的凌虐部屬罪、不應懲罰而懲罰罪與阻撓部屬陳情罪等】案件，在第一階段生效日移送一般法院審理，其餘案件在軍審法公布修正後五個月生效，再移送審判。因此，眾所矚目的洪仲丘命案，也會在15號生效日當天移到桃園地方法院，由三個專業軍事法庭公開抽籤分案。

司法院刑事廳長林俊益說，各地方法院自生效日起成立專業軍事法庭。

經過分析，符合第一階段移送的案件，共有178件、219人，分別移送台灣高等法院、台北地院、福建金門地院等24個法院；而審判中被告在押者共15人，其中4人移送台灣高等法院、高雄高分院8人、高雄地院1人、桃園地院2人。
